Child abuse is when an older person or another child does an action that takes the right of a child. According to UNICEF, this law can be applied to anyone under the age of 18. Child abuse can be done by anyone, without age and relation limits.
Child abuse is divided to multiple categories: physical (beating, slapping, physical punishments), sexual (violation of body privacy), emotional/psychological (insulting, cursing), child neglect (not providing basic needs), exploitation (use of children for someone else’s advantage) and child trafficking (trade of minors for exchange of favor/money). Here, we won't focus on one specific type, but we'll focus on the effects that it can cause on our future.
The effects of child abuse surprisingly can last until lifetime. The trauma of childhood abuse can overshadow them from trusting another person, or stop them from interacting with their close ones. The victims of child abuse might turn to the wrong ways, like alcohol and illegal drugs. They can also develop depression, which can lead to mental illness such as anxiety and eventually having self-harming or suicidal thoughts.
Other than harming themself, they can also harm another creature, namely people and animals, who they think is a threat. For example, a person was physically harassed by their father. They automatically lose a father figure, and take any older man around them as a threat. Let's use another example I got of the internet. There was a case of a girl who stole professionally. Why would she do that? Because her mother was an addict who taught her to steal. The only thing that could brought her mother joy is money, and she just want to make her mother happy. Every child craves love and attention from their parents.
Child abuse cases rose because of the pandemic. The deputy for Child Protection from the Ministry of Women's Empowerment and Child Protection (KemenPPPA), Nahar said that during the pandemic, the online information system for the protection of women and children recorded more than six thousand reports of forms of violence against children. On 2019, it is noted that there are 11,057 reported cases of child abuse, then the numbers rise to 11,278 in 2020.
Just because of these facts, a child can't be disobedient to their parents and takes advantage of the facts I've listed above so they won't take their consequences. The worse you do, the worse your consequences. In the Quran in Surah Al Isra in the 23rd verse,
وَقَضَىٰ رَبُّكَ أَلَّا تَعْبُدُوا إِلَّا إِيَّاهُ وَبِالْوَالِدَيْنِ إِحْسَانًا ۚ إِمَّا يَبْلُغَنَّ عِنْدَكَ الْكِبَرَ أَحَدُهُمَا أَوْ كِلَاهُمَا فَلَا تَقُلْ لَهُمَا أُفٍّ وَلَا تَنْهَرْهُمَا وَقُلْ لَهُمَا قَوْلًا كَرِيمًا
Meaning: "And your Lord has commanded you not to worship other than Him and to do good to your parents. If one of the two or both of them reaches an advanced age in your care, then you should never roll your eyes (being snobby) and do not you shout to them both, and speak to them both good words." (QS Al-Isra ': 23).
With this verse taking the parents' side, this verse can't be misapplied as a reason for parents giving their children over consequences. It was narrated by Abu Hurairah RA that Rasulullah SAW was kissing Al-Hasan ibn ʻAli while Al-Aqra` ibn Habis At-Tamimi was sitting next to him (Rasulullah). Al-Aqra` said, "I have ten children and never kissed any of them." The Prophet Muhammad looked at him and said, "Anyone who is not merciful to others will not be treated with compassion." (Reported by Al-Bukhari). This story shows us how the Prophet cares much to children and that every children deserves love and mercy.
In Indonesia, child abuse laws have existed since 2002, but it is not as strong as other countries' laws. While physical and sexual abuse are easier to be solved by court law, psychological abuse is more difficult since 'no evidence is present'.
In the Article 76C Law 35/2014, Everyone is prohibited from placing, allowing, doing, ordering to do, or participating in violence against children. This include ordering and executing, even if people will say executors are just executors. No, executors are the reason why cases like this happens. Yes, the idea generator/s is/are the one who gave ideas, thus ideas will not happen if the idea isn't executed.
In Article 76A of Law no. 35/2014 “Everyone is prohibited from: a. treating children in a discriminatory manner which results in the child experiencing losses, both material and moral, thereby hindering their social functions; or b. treat Children with Disabilities in a discriminatory manner.
The sanctions for these violations are listed in article 80 of Law no. 35 of 2014 Amendments to Law Number 23 of 2002 concerning Child Protection.
(1) Everyone who violates the provisions referred to in Article 76C, shall be punished with imprisonment for a maximum of 3 (three) years 6 (six) months and/or a maximum fine of Rp. 72,000,000.00 (seventy-two million rupiahs).
(2) In the event that the child referred to in paragraph (1) is seriously injured, then the offender shall be punished with imprisonment for a maximum of 5 (five) years and/or a fine of up to Rp. 100,000,000.00 (one hundred million rupiah).
(3) In the event that the child referred to in paragraph (2) dies, the offender shall be punished with imprisonment for a maximum of 15 (fifteen) years and/or a fine of up to Rp. 3,000,000,000.00 (three billion rupiahs).
(4) The penalty is added to one third of the provisions referred to in paragraph (1), paragraph (2), and paragraph (3) if the perpetrators of the abuse are the parents.
If the offender is still a minor (under the age of 18), the offender is sentenced to rehabilitation, since the offender is also a victim of child abuse. In March of 2020, NF, a junior high school student was accused of murdering a toddler with the initials APA (5) whose body was kept in a cupboard, was sentenced to two years in prison. NF was charged with Article 76C of the Indonesian Law No.35 of 2014 concerning Amendments to the Indonesian Law No.23 of 2002 concerning Child Protection, juncto Article 80 Paragraph (3) of the Indonesian Law No.35 of 2014 concerning Amendments to RI Law No.23 of 2002 on Child Protection. For this, NF was sentenced to prison and placed in the Handayani Jakarta Social Welfare Administration (LPSK).
Now, NF is much better. While undergoing a period of psychological recovery at the Handayani Children's Center, Cipayung, East Jakarta, NF has started to open up and want to socialize with others. Turns out that NF was a victim of sexual abuse from 3 men. Ironically, all of the men who raped her are her closest ones, two being her uncle and one being her ex-lover. Because of the sexual abuse and the murder of the toddler, NF is in the position of being a victim as well as being the murderer.
NF is more open socially and is a much better person that she is before. The last time we've heard of her, she's pregnant in her 5th month, and does annuall check up to the doctor. This is a proof that rehab can change someone's way of living and turn them to a better version of themself.
